Each level of the appeal process will generate a formal letter stating the rendered decision to the parent and copied to the school team and the student's cumulative record. ix. Those students who are English Language Learners (ELL) will be provided appropriate accommodations based on their Individual Learner Plan (ILP) developed by the English as a Second Language (ESOL) teacher and provided to the classroom teacher. The ILP be made available through the district’s student database for all teachers assigned to the ELL student. When retention of an EL is determined to be the best option, evidence of multiple interventions and scaffolded instructional strategies must be documented to demonstrate the student is being retained for reasons other than a lack of English proficiency. C. Placed in Next Grade 1. Students may be "placed" but not “promoted” in the next grade based on evidence of insufficient progress. A student "placed" in the next grade must meet at least one of the following criteria: a. Has been retained at least once in the previous grade and has continued to show evidence of little or no progress in academic grades, content assessments, etc. b. Has been seriously considered for non-promotion in the current grade and for whom the decision has been made by the team not to retain. Being "placed" in the next grade level indicates the student, may be "at risk" for achieving success. 2. The Student Services Team is required to create a formal, written, detailed Individualized Learning Plan for the student who is "placed" in the next grade, to be used to provide support to the struggling student in the next grade level. The student must be maintained on the Student Services Team roster for the next school year. The SST will monitor the Individualized Learning Plan and provide appropriate interventions. 3. Parents/Guardians are requested to sign the Wicomico County Public Schools “NonPromotion” form during a face-to-face meeting with the classroom teacher, the principal, and others designated by the principal. Signature indicates receipt of form as noted below parent/guardian signature line on the form. The Non-Promotion form and a formal letter from the principal indicating the decision to “place” the student in the next grade are mailed to the parent/guardian and copied to the student’s cumulative record file and to the Student Services Team accompanied by the Wicomico County Public Schools “NonPromotion” form. 4. Parents/Guardians who are not in agreement with the school team to place their child in the next grade for the coming school year instead of a promotion must follow the appeal process, in writing, to the principal (Level I), followed by the Director of Elementary Education (Level II), the Chief Academic Officer (Level III) and then the Superintendent
